TERMS AND CONDITIONS OF THE PROMOTION

1 GENERAL PROVISIONS

1. These Terms and Conditions set out the rules binding on each Promotion Participant for the purchase of discounted tickets on every Wednesday in September and October ("Half-Price Wednesday"). The Promotion is organised by Bajka Pana Kleksa Spółka z ograniczoną odpowiedzialnością with its registered office in Katowice (postcode 40-246) Katowice, ul. Porcelanowa 23, with the assigned tax identification number (NIP): 954-242-74-90, which is the owner of the ‘Bajka Pana Kleksa’ Culture, Science and Entertainment Centre (hereinafter referred to as the ‘Organiser’).
2. The Promotion will run from 5 March 2025 to 25 June 2025, subject to §6 point 1, or until the pool of available places is exhausted.
3. The promotion applies only to individual customers.

2 DEFINITIONS

1. Promotion – the offer prepared by the Organiser for the sale of tickets, on the terms specified in these Terms and Conditions. The Promotion cannot be combined with other promotions, discounts, rebates, etc.
2. Promotion Participant – an individual customer, meaning an adult natural person who is a consumer within the meaning of Article 221 of the Civil Code, who, during the Promotion period specified in §1 point 2, meets the conditions set out in § 3 of the Terms and Conditions.
3. Organiser's headquarters – reception desk of ‘Bajki Pana Kleksa’, located at 40-246 Katowice, ul. Porcelanowa 23.

3 TERMS AND CONDITIONS OF THE PROMOTION AND PARTICIPATION

1. The sale covered by the Promotion will take place in the Online Store, located at https://bilety.bajkapanakleksa.pl/, https://bilety.kleksmagiakina.pl and at the Organiser's Headquarters.
2. Participants in the Promotion have the right, but not the obligation, to take advantage of the Promotion.
3. Only individual customers may participate in the Promotion.
4. The Promotion applies only to events labelled ‘Half-Price Wednesday’, [„Swobodna Środa za Pół Ceny”, "Swobodna Środa w Kleks. Magia Kina za pół ceny" oraz "Środa za pół ceny w Kleks. Magia Kina"] held every Wednesday at Bajka Pana Kleksa, Kleks. Magia Kina in Katowice and Kleks. Magia Kina in Warsaw, excluding birthdays, group offers, summer camps and day camps, workshops and screenings, special events, combined tickets and vouchers/gift certificates.
5. Ticket prices in the Online Store, located at https://bilety.bajkapanakleksa.pl/, https://bilety.kleksmagiakina.pl, are given taking into account the promotional conditions, i.e. their price has been reduced by 50% compared to similar events taking place on other working days of the week, i.e. Monday, Tuesday, Thursday, Friday, Saturday and Sunday.
6. Participation in the Promotion means:
6.1. The Participant's consent to all terms and conditions of the Promotion set out in these Terms and Conditions;
6.2. Confirmation of fulfilment of the conditions entitling the Participant to take part in the Promotion.
7. The Promotion cannot be combined with other promotions, discounts, rebates, etc.
8. Tickets covered by the Promotion purchased as part of participation in the Promotion are non-refundable and non-exchangeable.

4  PROMOTIONAL MATERIALS

Information about the Promotion contained in advertising materials does not constitute an offer or a public promise. The Organiser is not responsible for any incorrect or incomplete reading of the Promotion slogan.

5 COMPLAINTS

Any complaints related to the course of the Promotion must be submitted by the Promotion Participant within 3 days of purchasing the tickets or attempting to purchase them, by e-mail to the Organiser's e-mail address: bilety@bajkapanakleksa.pl, bilety@kleksmagiakina.pl and warszawa@kleksmagiakina.pl for the purpose of considering the validity of the complaint or request.

6 FINAL PROVISIONS

1. The Organiser has the right to cancel or shorten the duration of the Promotion without giving reasons, by posting information on the Internet at https://bilety.bajkapanakleksa.pl/, bilety@kleksmagiakina.pl and warszawa@kleksmagiakina.pl
2. During the Promotion, the Organiser reserves the right to amend these Terms and Conditions. The amendment shall take effect on the date of publication of the relevant written information on the Internet at https://bilety.bajkapanakleksa.pl/ and https://bilety.kleksmagiakina.pl.
3. The Organiser shall not be liable for any disputes arising from causes attributable to third parties.
4. The Terms and Conditions are available for inspection at the Organiser's headquarters: 40-246 Katowice, ul. Porcelanowa 23.
5. All requests regarding the processing, violation or suspected violation of Personal Data should be addressed to the Personal Data Administrator by sending an email to: bilety@bajkapanakleksa.pl, bilety@kleksmagiakina.pl and warszawa@kleksmagiakina.pl.
